Visa Transaction Controls Disclosure

The Transaction Controls service is a card management application provided by the Credit Union as the issuer of your credit, debit and ATM cards. These terms apply exclusively to your access to and use of the Transaction Controls service and do not alter the terms or conditions of any agreement you may have with the Credit Union. The Transaction Controls service can be used to establish credit, debit , and ATM card acceptance or use (on/off) controls. From time to time, we may make additional card control features available to you. The Credit Union does not guarantee that the Card Control Service will be available at all times or in all areas. The Credit Union reserves the right, at any time, without notice, to terminate, restrict or modify the Card Control Service.

1. Conditions of Use. You are solely responsible for all information and data you input into the Transaction Controls, the controls, authorizations and any access you give to any other person to Transaction Controls or your card account. You agree to comply with all additional restrictions provided in Transaction Controls as they may be updated from time to time.
2. Liability Disclaimer. THE CREDIT UNION DOES NOT MAKE ANY WARRANTY THAT YOUR USE OF TRANSACTION CONTROLS OR THE MATERIALS WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE, OR THAT DEFECTS, IF ANY, WILL BE CORRECTED. THE CREDIT UNION DOES NOT GUARANTEE THAT A TRANSACTION WILL BE DECLINED WHEN A CONTROL IS SET. THE CREDIT UNION ASSUMES NO RESPONSIBILITY FOR DAMAGES THAT MAY BE SUFFERED BY YOU, INCLUDING, BUT NOT LIMITED TO, LOSSES FROM DELAYS, NONDELIVERIES OF CONTENT OR ANY COMMUNICATIONS, ERRORS, SYSTEM DOWN TIME, MISDELIVERIES OR MISCOMMUNICATIONS, NETWORK OR SYSTEM OUTAGES, FILE CORRUPTION, OR SERVICE INTERRUPTIONS CAUSED BY THE NEGLIGENCE OF THE CREDIT UNION AND LICENSORS, OR YOUR OWN ERRORS AND/OR OMISSIONS. TRANSACTION CONTROLS AND MATERIALS IN TRANSACTION CONTROLS, ARE PROVIDED “AS IS” WITHOUT ANY REPRESENTATION OR WARRANTY, EXPRESS OR IMPLIED, OF ANY KIND, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, NONINFRINGEMENT, OR FITNESS FOR ANY PARTICULAR PURPOSE. SOME JURISDICTIONS DO NOT ALLOW FOR THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
3. Limitation of Damages. THE CREDIT UNION'S LIABILITY FOR ANY CLAIMS, DAMAGES OR LOSSES FOR UNAUTHORIZED USE OF YOUR CARD OR IMPROPER CARD TRANSACTIONS WILL BE LIMITED AS SET FORTH IN THE EFT AGREEMENT WITH THE CREDIT UNION. IN NO EVENT SHALL THE CREDIT UNION BE LIABLE TO YOU OR ANY PERSON FOR ANY INDIRECT, SPECIAL, CONSEQUENTIAL OR OTHER DAMAGES (INCLUDING, WITHOUT LIMITATION, ANY LOST PROFITS, BUSINESS INTERRUPTION, LOSS OF INFORMATION OR PROGRAMS OR OTHER DATA ON YOUR INFORMATION HANDLING SYSTEM) THAT ARE RELATED TO THE USE OF, OR THE INABILITY TO USE, THE CONTENT, MATERIALS, AND FUNCTIONS OF THE APPLICATION OR ANY LINKED APPLICATION, EVEN IF THE CREDIT UNION IS EXPRESSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
